The latest legal attempt to stop the Badger cull failed yesterday.

The Badger Trust, who appealed the Court's decision, said they were disappointed that the court has decided to uphold the decision to allow the cull, which is due to start in a matter of weeks.

The Government have argued the culls are a necessary attempt to control Bovine TB.

David Wolfe QC, for the Trust, has estimated that 3,400 badgers in each area will be killed.

Brian May, guitarist for Queen, is among those campaigning against the Badger Cull. He appeared at the Brewhouse Theatre in Taunton last July to speak on the issue.

He said: "It is very hard for me to understand why the Government is so keen on this policy

"I am a scientist, I have read the papers and there is no reason, scientifically economically and ethically for this.

"A scientist has to be impartial and I believe the Government doesn't know the difference between scientific theory and scientific evidence.

"For me it is very sinister that the law in the countryside has been broken, this is own to the Prime Minister, he is responsible for all the butchery."

Chief executive of the RSPCA Gavin Grant, from Wellington, said: "Badgers don't vote, they don't speak out, they rely entirely upon us, cattle and badgers are all God's creatures and they deserve our respect."

The Badger Trust said it was disappointed with the court's decision.

A spokesperson for the Badger Trust said: "The Badger Protection Act has the purpose of protecting the species, and it hasn't.

"It seems that unfortunately scientific fact cannot be tested in court."

"The science relating to culling remains completely unaffected and clear. Unfortunately scientific fact cannot be tested in court."
